This Privacy Policy explains how Arca ("we", "us", or "our") collects, uses, and protects your personal information when you use our platform at buildwitharca.com. We are committed to protecting your privacy and handling your data transparently and responsibly.
By using Arca, you agree to the collection and use of information as described in this policy.
What We Collect
Information you provide directly
- Account information: Your name, email address and password when you register
- Payment information: Billing details processed securely by Stripe — we never store your full card number
- Brand voice settings: Tone preferences, audience description and style settings you configure
- Content you create: Prompts, chat messages, generated images, documents and voice recordings while using Arca
Information collected automatically
- Usage data: Which tools you use, how often, and how long sessions last — used to improve the product
- Device information: Browser type, operating system, IP address and referring URL
- Cookies: Session cookies to keep you logged in, and analytics cookies (you can opt out)
How We Use Your Information
- To provide, maintain and improve the Arca platform
- To process payments and send billing receipts
- To send transactional emails (account, billing, usage alerts)
- To apply your brand voice settings across AI tools
- To monitor usage against plan limits
- To detect and prevent fraud or abuse
- To respond to support requests
- To send product updates — you can unsubscribe at any time
Who We Share Your Data With
We share your data only with the third-party services necessary to operate Arca:
- Anthropic, OpenAI, Google, xAI, DeepSeek: Your prompts and messages are sent to these AI providers to generate responses. Each provider has their own privacy policy. We send only what is necessary to generate your response.
- Stripe: Processes all payments. We do not store your card details.
- Vercel: Hosts the Arca platform. Your data is stored on their infrastructure.
- ElevenLabs: Processes voice and text-to-speech requests when you use Voice Studio.
⚠️ We never sell your personal data to advertisers, data brokers or any third party. We never have and never will.
AI & Your Content
🛡️ Your content is never used to train AI models. We have opted out of all AI provider training agreements where possible. Your prompts, outputs and documents belong to you.
When you use AI tools within Arca, your prompts are transmitted to the relevant AI provider (Anthropic, OpenAI, etc.) to generate responses. These providers process your data according to their own terms. We recommend reviewing their privacy policies if you handle sensitive information.
We do not retain copies of your AI conversations beyond what is needed to display your chat history within the app (which you can delete at any time).
Data Retention
- Account data: Retained while your account is active and deleted within 30 days of account deletion
- Chat history: Free plan — 30 days. Creator and Team plans — unlimited until you delete it
- Generated images and documents: Stored while your account is active
- Payment records: Retained for 7 years as required by Australian tax law
- Usage analytics: Anonymised and retained for up to 24 months
Your Rights
Under the Australian Privacy Act 1988 and GDPR (for users in the EU), you have the right to:
- Access the personal data we hold about you
- Correct any inaccurate information
- Delete your account and associated data
- Export your data in a portable format
- Opt out of marketing emails at any time
- Object to certain types of data processing

Security
We take reasonable technical and organisational measures to protect your data:
- All data transmitted between your browser and Arca is encrypted via HTTPS/TLS

- Payment data is handled entirely by Stripe and never passes through our servers in full
- We conduct regular security reviews of our infrastructure

Terms of Service
The short version: Use Arca for legal creative work, pay your subscription on time, don't abuse the platform, and we'll keep it running well for you.
These Terms of Service ("Terms") govern your use of Arca, operated by Arca Pty Ltd ("Arca", "we", "us"). By creating an account or using our platform, you agree to these Terms.

Accounts
- You must be at least 18 years old to create an account
- You are responsible for maintaining the security of your password
- You must provide accurate information when registering
- One person may not operate multiple free accounts to circumvent usage limits
- You are responsible for all activity that occurs under your account
- Notify us immediately at hello@buildwitharca.com if you suspect unauthorised access
Acceptable Use
You agree not to use Arca to:
- Generate content that is illegal, defamatory, harassing or threatening
- Create deepfakes or impersonate real people without consent
- Generate content that sexualises minors
- Produce spam, phishing content or malware
- Infringe on the intellectual property rights of others
- Attempt to reverse-engineer, scrape or overload our systems
- Resell or redistribute Arca's AI outputs as a competing AI API service
- Violate the terms of any third-party AI provider whose models we use
⚠️ Violating these terms may result in immediate account suspension without refund.
Payments & Billing
- Billing cycle: Subscriptions are billed monthly on the anniversary of your sign-up date
- Currency: All prices are in USD unless otherwise stated
- Payment processing: Handled by Stripe. By subscribing you agree to Stripe's terms
- Failed payments: If a payment fails, we will retry 3 times over 7 days before suspending access
- Cancellation: You can cancel anytime. Access continues until the end of your billing period
- Refunds: We offer a 30-day money-back guarantee on first-time paid subscriptions. After that, refunds are at our discretion
- Price changes: We will give 30 days notice before any price increase
- Downgrades: Take effect at the start of your next billing cycle
Intellectual Property
Your content
You own the content you create using Arca — your prompts, outputs, documents and generated images. You grant us a limited licence to store and display your content solely to provide the service.
Our content
The Arca platform, design, code and brand are our intellectual property. You may not copy, reproduce or redistribute them without written permission.
AI-generated content
The legal status of AI-generated content varies by jurisdiction. You are responsible for ensuring your use of AI outputs complies with applicable laws in your region.
Liability
Arca is provided "as is" without warranties of any kind. To the maximum extent permitted by law:
- We do not guarantee that AI outputs are accurate, complete or suitable for your purpose
- We are not liable for any indirect, incidental or consequential damages arising from your use of Arca
- Our total liability to you in any month shall not exceed the amount you paid us in that month
- We are not responsible for the content, accuracy or policies of third-party AI providers
Nothing in these Terms excludes rights you have under the Australian Consumer Law that cannot be excluded.
Termination
By you: You can cancel your account at any time from Settings → Danger Zone or by emailing hello@buildwitharca.com.
By us: We may suspend or terminate your account immediately if you violate these Terms, particularly the Acceptable Use policy. We will give 30 days notice for any other termination without cause.
On termination, your right to use Arca ends. We will retain your data for 30 days after which it is permanently deleted, except where retention is required by law.
Changes to These Terms
We may update these Terms from time to time. For material changes, we will:
- Email you at least 14 days before changes take effect
- Post a notice in the Arca dashboard
- Update the "Last updated" date at the top of this page
Continued use of Arca after changes take effect constitutes your acceptance of the new Terms.
